Leaving Foster Care

When you are 18 or older, you may choose to discontinue receiving Independent Living services anytime before your 21st birthday. You also have the legal right to request a resumption of these services.

Leaving Foster Care

It is critically important to understand that the request to resume services must be made within 60 days of the date services were stopped. It is also important to understand that the request may be denied; there is no guarantee that services will be resumed.

You are eligible to resume Independent Living services if you:

  • Return for independent living services within 60 days of discontinuing services.
  • Are between the ages of 18 and 21 but have not yet reached your 21st birthday.
  • Were in the custody/care of a Local Department of Social Services (LDSS) in Virginia at the time of your 18th birthday
  • Are a resident of Virginia.
  • Complete an initial application requesting services.
  • Enter an agreement specifying your responsibilities, the LDSS and other providers as appropriate.
  • Are not on active military duty.

You will be required to submit an application requesting services and sign an agreement that lists conditions for service resumption. Details of the process are available at: http://www.dss.virginia.gov/files/division/dfs/youth_servies/intro_page/learn_more/guidance_procedures/resuming_ilp.pdf
